What is the purpose of the processing of your personal data?
We process your data to create a database of candidates who choose to fill vacant positions in the entity. Data from your CV will be stored as long as you continue to provide your consent for this and for no longer than one (1) year as of the date of receipt of the same. Automated individual decisions will not be made. Curricular profiles will be created based on the information provided by you, to adjust your profile to the characteristics of the vacant positions.
Specifically:
- Search, selection, and evaluation of the candidates for possible recruitment;
- Selection and evaluation for future vacancies, as well as to share the candidate profile with one or more companies of the Riva Group:
- The application of an exclusion list of candidates with which, for reasonable purposes, the controller uses to exclude the possibility of establishing future contractual relationships based on criteria reflecting serious objective behaviour (for example: presenting false documentation during the selection process; aggressive and/or offensive conduct in their relationship with the HR department; spontaneous statements that are contrary to the company’s ethical/moral principles; candidate’s failure to assume the job upon signing of the contract proposal).
What is the legitimacy for the processing of your data?
Your personal data is processed based upon the consent that you provided to include your curricular data in a database of candidates who choose to fill vacant positions of the entity. If your data is not provided, it will be impossible to ensure your participation in future personnel selection processes.
The legitimate basis for the processing of the collected data is the requirement to enforce a contract of which the subject of said data is party, or to apply pre-contractual measures upon request of the latter (art. 6.1.b GDPR);
The application of pre-contractual measures adopted upon request of the interested party. For any specific data provided (for the contracting of protected categories), the need to comply with the obligations or exercise the rights according to applicable labour law (in accordance with Article 9(2)(b) GDPR).
To whom will your data be communicated?
Your data may be communicated to other companies of the RIVA GROUP for business management purposes, which may possibly involve international data transfer (always in EU territory). Your data will be communicated to the Public Administrations requesting it, in compliance with the law.
What are your rights when providing us with your data?
Interested parties have the right to obtain confirmation regarding whether or not we are processing their personal data. They have the right to access their personal data, and to request the rectification of inaccurate data or, as appropriate, to request its deletion when, among other reasons, the data is no longer necessary for the purposes for which they were collected. Interested parties have the right to revoke or withdraw their consent for the processing of their data for specific purposes at any time. Under certain circumstances and for reasons related to their specific situation, interested parties may object to the processing of all or part of their data, in which case, we will cease to process said data, except to fulfil legal obligations. Under certain circumstances, interested parties may request the limitation of the processing of their data, in which case we will only store said data to exercise or defend against claims and to fulfil legal obligations. When the processing is carried out by automated means and this is based on the consent of the interested parties, said parties may request the portability of their data for transfer to another controller.
Under certain circumstances (where the basis of legitimation is contract execution or the consent of the interested party), the interested parties may request their right not to be the subject of a decision based solely on automated processing, including profiling, which has legal effects or significantly affects them in a similar manner.
